When a sex crime is alleged, emotions run high. Jurors have a tendency to be biased against someone on trial for this type of offense. For that reason, many people are wrongfully convicted.
Jury Selection is paramount in these cases. Otherwise, the accused doesn’t stand a chance. NEIL PASK knows how to get jurors who could be biased against you struck from the jury panel. Neil has experience with both the prosecution of these crimes and the successful defense of them.
In Texas there are a wide range of sex cases that an individual can be charged with, including:
- Aggravated Sexual Assault
- Sexual Assault of a Child
- Sexual Performance of a Child
- Public Lewdness
- Prostitution
- Compelling Prostitution
- Indecent Exposure
- Indecency with a Child
- Possession of Child Pornography
- Improper Relationship between Educator and Student
Penalties for Sex Offenses are tough. Aggravated Sexual Assault is a First Degree Felony, punishable by a minimum of 5 years in prison and a maximum of Life. A person commits the offense of Continuous Sexual Abuse of a Young Child or Children if during a period that is 30 or more days in duration, the person commits two or more acts of sexual abuse, regardless of whether the acts of sexual abuse are committed against one or more victims and the victim is younger than 14 years of age. Continuous Sexual abuse is also a First Degree Felony but has a special punishment range of 25 years in the penitentiary up to Life.
One of the worst consequences of having a sex crime on your record is having to register as a sex offender for certain offenses. For many serious offenses such as sexual assault, sexual performance by a child, compelling prostitution, possession or promotion of child pornography, an individual will have to register for the rest of their life. You must register as a sex offender even if you get deferred adjudication. To make matters worse, the location of the registered sex offender’s home will be disclosed. With stakes this high, you can’t afford to have less than aggressive representation.
In order to successfully defend a sex offense, a thorough investigation of the facts needs to be conducted. All witnesses will be interviewed and a background investigation of the alleged victim will be performed. Any motives the alleged victim has to make a false allegation will be fully explored. In short, no stone will be left unturned.
It is so easy for someone to make an allegation of sexual abuse. But being falsely accused of sexual abuse is everyone’s worse nightmare. And if there were no witnesses to the offense, the allegation is hard to defend. For that reason you need an attorney who has the experience necessary to defend one of these cases, and an attorney who will fight for your rights.
